The 2007 Defense Authorization Bill,... For military forces to be used under the provisions of the revised Insurrection Act, the following conditions must be met:

(1) The President may employ the armed forces, including the National Guard in Federal service, to--
.
(B) suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy if such insurrection, violation, combination, or conspiracy results in a condition described in paragraph (2).

(2) A condition described in this paragraph is a condition that--

(A) so hinders the execution of the laws of a State or possession, as applicable, and of the United States within that State or possession, that any part or class of its people is deprived of a right, privilege, immunity, or protection named in the Constitution and secured by law, and the constituted authorities of that State or possession are unable, fail, or refuse to protect that right, privilege, or immunity, or to give that protection; or

(B) opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws.

The internet was created by the US MILITARY (ARPANET) to coordinate military weapons developments between military buyers, civilian corporate contractors and civilian university contractors, all dispersed across the entire USA. It had no 4th Amendment rights from the inception and all aspects of communications were knowingly monitored by overt military personnel.

This situation endured for decades while the open-source UNIX developments brought in more universities and college students and alternate networks.

In 1972 there were 23 mainframe computers linked into the proto-internet ARPANET, including one commercial service LEXIS which charged $1 per minute, $60 per hour, to search their database online to all comers. By 1975 there were 108 computer systems linked and it was skyrocketing soon into the thousands.

A 1982 handbook on computing at MIT's AI Lab stated regarding network etiquette:[20]

It is considered illegal to use the ARPANet for anything which is not in direct support of Government business ... personal messages to other ARPANet subscribers (for example, to arrange a get-together or check and say a friendly hello) are generally not considered harmful ... Sending electronic mail over the ARPANet for commercial profit or political purposes is both anti-social and illegal. By sending such messages, you can offend many people, and it is possible to get MIT in serious trouble with the Government agencies which manage the ARPANet.[20]
